INFORMATION ON THE PROCESSING OF PERSONAL DATA IN ACCORDANCE WITH ARTICLE 13 OF REGULATION (EU) 2016/679

This information is provided pursuant to and for the purposes of Article 13 of Regulation (EU) 2016/679 of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (hereinafter also "GDPR"). It is intended to inform you, as the data subject, that, as part of the services provided to you as a user of the "photomodel.world" website, your personal data will be processed in the manner and for the purposes set out below.

Your personal data will be processed by the Controller for the following purposes:
(a) the establishment of the contractual relationship between you and the Controller (for example, by creating a user account and subscribing to a subscription associated with it to enable you to access the functionalities that the Controller makes available to its users, also against payment, such as access to 'premium' video content and images and the receipt of a newsletter);
b) the fulfilment of all obligations, including those of a fiscal or administrative nature, incumbent on the Controller;
c) carrying out commercial and marketing activities to send you offers or promotions (e.g. by e-mail) similar to those you have already subscribed to as a user of the service provided by the Controller;
(d) the establishment, exercise or defence of a legal claim.

The legal basis for the processing of personal data that pursues the purposes under a) is the performance of a contractual or pre-contractual relationship (Art. 6(1)(b) of the GDPR). The legal basis for personal data processing that pursues the purposes sub b) is the fulfilment of legal obligations to which the Controller is subject (Art. 6(1)(c) of the GDPR). The legal basis for the processing of personal data that pursues the purposes under c) and d) is the pursuit of a legitimate interest on the part of the Data Controller of processing (Art. 6(1)(f) of the GDPR). If the processing of personal data relates to particular categories of personal data, the processing will be carried out on the basis of Article 9(2)(a) of the GDPR. The provision of personal data for the achievement of the purposes under a), b) and d) is mandatory, as any refusal on your part to provide your personal data would make it impossible for the Controller to provide its service. The provision of personal data for the achievement of the purposes sub c) is optional.

The personal data processed belong to the following types:
- personal data such as: email address,first name,last name,user type,instagram account username,personal portfolio site link,personal biography,personal images uploaded to the site and all images on the photomodel.world site;
- special categories of personal data, in particular data and information from bookings, availability and reviews entered on photomodel.world.

Specific Location and Use:

During the registration or booking process on the photomodel.world platform, the user will be asked to provide information regarding their specific geographic location and position. This information includes, but is not limited to, your physical address, city, region, latitude and longitude, as well as other relevant location information.

You expressly consent to the provision of such data, which will be processed in accordance with applicable privacy legislation. The specific location and position may be used for:

Easy connection between models and photographers based on geographical distance;
Improving the user experience by suggesting relevant services and opportunities;
Fulfilling contractual obligations arising from bookings or services offered on the platform.

You acknowledge that failure to provide accurate information regarding your location and position may limit your access to certain features of the platform. In addition, you undertake to keep this information up-to-date so that the platform can offer a more accurate and personalised service.

You have the right to access, correct, or request deletion of such personal data, in accordance with photomodel.world.

The processing of your personal data shall be carried out by automated means (also by the use of techniques such as fingerprinting) and exclusively for the achievement of the purposes indicated in point 2, as well as for the time necessary for that purpose. The aforesaid processing shall be carried out using methods and logic that guarantee the security and confidentiality of the data, in such a way as to prevent and minimise the risks of destruction or loss, even accidental, of the data, or of unauthorised access, or of unauthorised or unlawful processing.

With particular regard to storage time:
- personal data collected for the purpose of the performance of the contractual relationship shall be processed for the entire duration of the same contractual relationship and for a period of ninety-nine (99) years following the termination of the said relationship, in order to enable the Controller to ascertain, enforce and protect its rights subject to the cancellation of the user's data, which shall be deleted from our systems in real time;
- personal data collected for the purpose of fulfilling the legal obligations to which the Controller is subject shall be processed for the duration foreseen for that purpose by the relevant legal provisions;
- personal data collected for further purposes will be processed for as long as the contractual relationship continues, subject to the exercise of rights by the data subject at any time;
- in case of litigation, personal data will be processed for the duration of the litigation.

Use and Processing of Email Address and Phone Number
By registering on our website, the user expressly and unconditionally consents to the processing of their personal data, in particular their email address and, if provided, phone number, for the purposes of:

publication and visibility of such data in their user profile, accessible to other registered users and the public, in accordance with the functionalities offered by the portal;
use of the data for commercial and promotional purposes related to the services offered by the site, including the possibility to send marketing communications, offers, and newsletters;
inclusion and display of the data within special or “premium” features of the portal, which may be unlocked through payment by the user or third parties;
limited and protected sharing of such data with partners or third parties involved in the provision of services, exclusively within the limits permitted by law.

The user acknowledges and agrees that, unless otherwise agreed, the email address and phone number will be processed and displayed as described above, and that such processing constitutes an essential part of the contractual relationship with the site. The user has the right to withdraw consent at any time by accessing their profile settings or contacting our Data Protection Officer. However, withdrawal of consent may limit access to certain features or services.

By accepting these terms, the user expressly authorizes the site to show other users when their profile has been viewed. Likewise, the user agrees that they will be able to see who has visited other users' profiles. This feature is an integral part of the service and is intended to promote interaction and transparency among users.

Your personal data may be communicated to:
a) subjects delegated and/or appointed by the Controller - for example: subjects who provide consultancy services to the Controller for the performance of activities strictly related to the pursuit of the purposes indicated in point 2;
b) persons authorised by the Controller to process personal data who have committed themselves to confidentiality or are otherwise subject to a legal obligation of confidentiality;
c) customers and suppliers, limited to the pursuit of purposes related to the performance of activities functional to the Controller's business;
d) subjects, bodies or authorities to whom the communication of your personal data is obligatory by virtue of provisions of law or regulations or orders of the competent authorities;
(e) third parties involved in the negotiation of any contracts for the acquisition of the Controller;
(f) customers and other users of the photomodel.world site.

Where necessary, the Data Controller will designate the aforementioned subjects as Data Processors. Apart from the aforementioned cases, your data will not be communicated except to natural or legal persons to whom communication is obligatory by law or regulation. Upon request addressed to us at the addresses indicated in point 1, we may provide you with a list of the subjects to whom your data will be communicated and processed.

Visibility and booking service:

"Photomodel.world merely provides a service of visibility and connection between users, enabling the creation of links and bookings. The site does not act as an official intermediary, nor does it guarantee the success of the agreements made between the parties."

Responsibility for payments:

"Any monetary transactions made outside of the platform, including those related to direct payments between users, are in no way the responsibility of Photomodel.world. Users are advised to personally verify the terms and conditions of any payment or agreement."

Subscriptions and internal services:

"The only payments handled directly by Photomodel.world concern any subscriptions or specific services offered by the platform. Any other form of payment made outside of these terms is not attributable to Photomodel.world."

Release from responsibility:

"Photomodel.world disclaims all liability for any disputes, disputes or defaults relating to bookings and payments made between users of the platform."

Use at your own risk:

"Use of the booking and visibility service offered by Photomodel.world is at the user's own risk and responsibility. You are advised to take all necessary precautions when handling transactions and external communications."

Your data may be transferred outside the European Economic Area if this is necessary for the achievement of the purposes indicated by the Controller. In this case, protection and security obligations equivalent to those guaranteed by the Controller will be imposed on the recipients of the data. In any case, only the data necessary for the pursuit of the purposes envisaged and described will be communicated and the guarantees applicable to data transfers to third countries will be applied, where required.

With reference to web navigation, we inform you that the Site uses cookies to make its services simple and efficient for Users who visit and use its pages.

Cookies are small data files, often containing an anonymous identification code, which are sent by a Web server to the User's browser and may subsequently be stored on the hard disk of the User's computer. The cookie is then re-read and recognised by the website that sent it each time a subsequent connection is made. Cookies contain information that makes it possible to store the User's browsing preferences and thus personalise a site according to the User's needs.

(i) persistent: these are cookies that, once the browser is closed, are not deleted but persist on the User's computer until a preset expiry date;

In particular, you have the right to: obtain confirmation as to whether or not personal data concerning you are being processed; where processing is actually taking place, to obtain access to your personal data and information relating to the processing as well as to request a copy of the aforementioned personal data; to obtain the rectification of your inaccurate personal data and the integration of your incomplete personal data; to obtain, where one of the conditions set out in Art. 17 of the GDPR, to obtain the deletion of your personal data; to obtain, in the cases provided for in Article 18 of the GDPR, the restriction of the processing; to receive your personal data in a structured, commonly used and machine-readable format and to request its transmission to another controller, where technically feasible. Furthermore, you have the right to object at any time to the processing of your data carried out in pursuit of a legitimate interest of the Controller. In the event of an objection, your data will no longer be processed, unless there are legitimate grounds for processing which override the interests, rights and freedoms of the data subject or for the establishment, exercise or defence of legal claims. You may also revoke your consent or object to the processing of your data at any time. The revocation of your consent shall not affect the lawfulness of the processing of personal data based on the consent given prior to the revocation. Finally, pursuant to Article 77 of the GDPR, we remind you that you have the right to lodge a complaint with the supervisory authority if you consider that your rights under the GDPR have been violated.

You must be at least 18 years of age to use this website. By using this website and agreeing to the terms and conditions you represent and warrant that you are at least 18 years of age.

By using the Site, you accept and agree to abide by these Terms of Use, which Photomodelworld may, at any time, change, supplement or amend in whole or in part and at its sole discretion, in particular where such changes are necessary for legal or technical reasons, or as a result of changes in the services offered or in the layout of the Site. photomodel.world will notify Users of changes to the Terms of Use. For the purposes of these Terms of Use, the term 'User(s)' includes users - whether registered or not - who use the Site to search for and/or review models, photographers or locations.

Photomodelworld may also without notice impose limits on certain services or terminate a User's access to all or parts of the Site for technical reasons, for security reasons, to prevent unauthorized access to the Site or loss or destruction of data, or if photomodelworld believes in its sole discretion that the User has violated these Terms of Use or any law or regulation, or in the event of termination of the service provided or upon description of photomodel.world.

Unless otherwise indicated in these Terms of Use, the Site, including, without limitation, its technical structure, algorithm, all text, images, trademarks, logos, pictures and anything else contained within the Site ("Site Content") are the SOLE property of Photomodelworld, all rights reserved. The Site Content may therefore not be used by third parties without the prior written permission of the owner.

All content entered and uploaded by the Users to the photomodel.world website becomes the property of Photomodelworld, without prejudice to the User's rights in relation to his/her personal data, provided upon registration of the website and/or during the use of the same, thus accepting that the e-mail address used for registration on the photomodel.world website shall be in plain text and public to all users and users of the photomodel.world website. For more information on the purposes and methods of processing your personal data, as well as to know the rights you can exercise in relation to your personal data, we invite you to read our Privacy Policy.

Photomodelworld may freely assign, transfer and/or transfer to third parties rights and obligations under these Terms of Use.

Users agree and acknowledge that no employment relationship, or agency agreement, or joint venture or partnership is entered into between them and Photomodelworld as a result of their use of the Site and their acceptance of these Terms of Use.

We offer and will offer advertising space on our site.

No activities allowed

The content and information on the portal (including, without limitation, messages, data, information, text, music, audio, photos, graphics, videos, maps, icons, software, code or other materials), as well as the infrastructure used to provide such content and information, are the property of photomodel.world. The User agrees not to modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, sell, resell the information, software, products or services obtained from or through the portal. Furthermore, the User accepts:

1) not to use the portal or its contents for commercial purposes;
2) not to access, monitor, copy the contents or information of the portal using robots, spiders, scrapers or other automatic means or manual processes for any purpose without the express written consent of Photomodelworld;
. 3) violate restrictions in robot exclusion headers on the portal or circumvent other measures taken to prevent or restrict access to the portal;
4) take measures to impose or attempt to impose a disproportionate or unreasonable load, at the discretion of Photomodelworld, on the portal infrastructure;
5) perform deep linking of any part of the portal for any purpose without the express written consent of Photomodelworld;
6) perform "framing", "mirroring" or other means of incorporating any part of the portal into other websites without the prior written consent of Photomodelworld;
7) Attempt to modify, translate, adapt, change, decompile, disassemble or reverse engineer software programs used by Photomodelworld in connection with the portal or services.

By registering on the Site, you expressly agree and warrant that you will use Photomodelworld's services in full compliance with these Terms of Use and that you will not violate the rights of any third party or any applicable laws by your conduct. You also agree not to publish or distribute any content or material covered by copyright or other intellectual property rights without the express consent of the relevant owner. You also undertake to include and/or publish on the Site content that you may freely and lawfully dispose of and that refers exclusively to you.

In consideration of these undertakings, you expressly agree and consent to hold Photomodelworld and the owner of the Site harmless from any liability to any person arising out of your use of the Site that is not in accordance with these Terms of Use or the law. You further represent that you are at least 18 years of age and are therefore legally capable of using this Site and the services offered herein in full compliance with all of these Terms of Use.

The services offered through such sites, as well as the content of such sites, may be subject to a fee. It is your sole responsibility to make all appropriate inquiries prior to any transaction to determine whether or not you will be charged a fee for the use of such services. Photomodelworld assumes no responsibility or liability whatsoever for the accuracy of such information, nor shall Photomodelworld in any way be associated with such third party sites or the content thereof.

Photomodelworld is a service provided to the user free of charge on an "as is" basis, without any warranty of any kind, either expressed or implied, or any kind of technical assistance or support.

Photomodelworld does not guarantee the truthfulness and accuracy of the information and content on the Site. In addition, Photomodelworld is not responsible for content posted by its Users through interactive areas on the Site.

Each User is solely and personally responsible for what he or she posts on the Site and Photomodelworld will, in accordance with the applicable legal provisions, immediately remove and/or block any illegal content, as well as cooperate - if required - with the competent authorities.

The Site also contains links to third party sites. The linked sites are not under the control of Photomodelworld, which therefore assumes no responsibility for their content.

Photomodelworld is providing these links as a convenience to its users and does not imply endorsement, sponsorship, or affiliation with the linked site. The linked sites provide independent services and are owned by third parties, and Photomodelworld cannot and does not assure users that they will be satisfied with the products or services or business practices of such third parties.

It is therefore advisable to carry out all necessary investigations before entering into a transaction with such third parties.

Reviews and use of interactive areas

The Site allows Users to post or submit material or reviews of their personal experiences, as well as the posting of other communications. Photomodelworld shall in no event be liable for any content posted, submitted or published by the User ("User Content"). Photomodelworld may delete, in its sole discretion and without notice, User Content and/or Site Content as provided in these Terms of Use. The following is an illustrative list of the types of User Content that are illegal or otherwise prohibited. The list includes user reviews that:

Photomodelworld reserves the right at all times to modify the contents of this list at its sole discretion, and to investigate and take appropriate action against anyone who violates these Terms of Use and/or applicable laws, including without limitation, removing an offending expression or preventing the offender from using the Site. If civil or criminal offences are committed through User Content, Photomodelworld will, upon notice from the offending person, immediately take steps to delete and/or block such Content and shall cooperate with law enforcement authorities, if requested.

By posting a review on the Site, the User grants Photomodelworld, without the possibility of revocation but without prejudice to its rights under the Privacy Policy, the right to use its Contents, which may be freely read, copied, published, translated and distributed by any means and in any form, as well as communicated to third parties for the performance of advertising and promotional activities related to the services offered by the Site.

The rights of use of uploaded images must be agreed upon by all parties involved (model, photographer, location). The photographer uploading the image must be the creator of the image.

Website licence
Unless otherwise indicated, Photomodelworld and/or its licensors own the intellectual property rights in the website and material uploaded to the website. Subject to the licence below, all such intellectual property rights are reserved. You may view, download and print pages from the website for your own personal use, subject to the limitations set out in the terms and conditions of use of the website.

Regulation for review authors

A review is a full and detailed account of a shoot between photographer and model, shared with other members of the Community. We encourage all Members of the Community to be truthful and honest about the experience and to adhere to the following Rules for posting reviews. Reviews must be and may be:

They are also used to make accusations, attempts at defamation or statements aimed at discrediting the contributions of other reviewers. The reviews will not be published.

-	Written by those who have actually had a shoot between photographer and model: only reviews that describe an experience and give an objective account are accepted.
-	Suitable for all: we do not accept reviews that are threatening, racially motivated, incite hatred, contain vulgar language or content that is not appropriate for our community.
-	Useful to other users: general narratives, not relevant to the meeting or comments of various kinds (political, ethical, religious, etc.) are not accepted.
-	Accusations, attempts at defamation or statements aimed at discrediting the contributions of other reviewers.
-	You may not quote nicknames or names of yourself or other users. Subsequent modification or deletion of the quoted account would constitute a breach of privacy. .
-	No reviews will be published that reveal private facts about the models or photographers or locations that are irrelevant to the assessment of its professionalism.
-	As a general rule, each user may only enter one review per shoot.
-	Original: we do not accept reviews already published elsewhere, including websites, forums, etc. .
-	Prive for commercial purposes: we do not accept promotional material of any kind, including self-referential URLs.
-	Written by persons over 18 years of age.
-	Validity of e-mail addresses: the e-mail address associated with the user account must be correct and reachable.
-	It is strictly forbidden to create multiple accounts. In the event of a proven violation, all accounts will be blocked and any reviews posted by these accounts deleted from the site. .
-	We do not accept texts that include HTML tags, typographic symbols, telephone numbers (nor others, nor the one reviewed).
-	Reviews must not contain any information other than that relating to the experience between model and photographer, with the main subject being the shoot. Subject to deletion.

Photomodelworld reserves the right to remove reviews when suspicion arises that the author has violated these Rules.

1. User-Generated Content

Users are strictly prohibited from posting, sharing, or transmitting any content that is:

Objectionable, offensive, abusive, defamatory, or hateful
Sexually explicit or inappropriate
Spam, misleading, or fraudulent

2. Zero Tolerance Policy

We have a zero-tolerance policy for abusive behavior or objectionable content. We reserve the right to remove any content and permanently suspend or ban users without prior notice.

3. Reporting and Moderation

Users can report objectionable content directly within the application. All reports are reviewed and acted upon within 24 hours.

4. Blocking Users

Users may block other users at any time. Content from blocked users will be immediately removed from the user's feed.

5. Enforcement

Violations of these terms may result in content removal, account suspension, or permanent ban.

Virtual Credits

The site uses a virtual credits system, an internal digital currency exclusively usable within the platform to access premium features, unlock contacts, increase visibility through boosts, or other paid services.

Credits have no real value and cannot be converted into cash or transferred to other users.

The availability, value, validity, and terms of use of credits are defined by the site and may be modified at any time with adequate communication to users.

Credits purchased through secure online payments are non-refundable, except in cases of proven technical malfunction.

The user is responsible for properly managing their account and credit balance; in cases of misuse, theft, or fraud, the site reserves the right to block or suspend the account and take necessary legal actions.

In case of anomalies or disputes regarding transactions, the user may contact support for verification.

Premium Subscription

The site also offers a premium subscription service lasting one month, which allows users to access exclusive features and additional benefits.

The subscription is automatically renewed unless cancelled by the user within the terms indicated in the subscription conditions.

Payment for the premium subscription follows the same secure methods and guarantees as credit purchases.

Online Payments

All payments for purchasing credits or paid services are handled through authorized external providers (e.g., PayPal, Stripe, banking circuits), who independently collect and process payment data according to their security policies.

The site does not store sensitive credit card data or financial information.

Transactions are protected by encryption and security systems compliant with industry standards.

Any disputes or refund requests must be handled directly through the payment provider, except in cases of certified site malfunctions.

Use of Paid Services

Activating services via credits or subscription implies authorization for the processing of personal data necessary to provide the service (e.g., usage data, interaction data).

The site commits to ensuring transparency and fairness in providing purchased services.

The user acknowledges and agrees that in case of violation of terms of use, fraudulent use, or abuse of paid services, the site may suspend or block access without obligation of refund.
